Reference is made to that certain Trust Deed made by, MANIRATH SAYNYARACK, A MARRIED MAN, AS HIS SOLE AND SEPARATE PROPERTY as Grantor to AMERITITLE LLC as Trustee, in favor of MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., as designated nominee for LEADERONE FINANCIAL CORPORATION, Beneficiary of the security instrument, its successors and assigns, dated as of July 20, 2023 and recorded on July 21, 2023 as Instrument No. 2023-04945 and the beneficial interest was assigned to NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING and recorded November 20, 2024 as Instrument Number 2024-08037 of official records in the Office of the Recorder of Umatilla County, Oregon to-wit: APN: 125592 | 4N3522AC-04000 LOTS 10, 11, 12, AND 13 IN BLOCK 1, SALING AND REESE'S ADDITION, TO THE TOWN, NOW CITY OF WESTON, UMATILLA COUNTY, OREGON;ALSO THAT PORTION OF THE VACATED ALLEY LYING ADJACENT TO LOTS 10, 11, 12 AND 13, VACATED BY ORDINANCE NO. S-77-3, RECORDED IN REEL 15, PAGE 1231, UMATILLA COUNTY MICROFILM RECORDS. Commonly known as: 110 N BROAD ST, WESTON, OR 97886 Both the Beneficiary, NewRez LLC DBA Shellpoint Mortgage Servicing, and the Trustee, Nathan F. Smith, Esq., OSB #120112, have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and notice has been recorded pursuant to Section 86.752(3) of Oregon Revised Statutes. The default for which the foreclosure is made is the Grantor's failure to pay: Failed to pay payments which became due Monthly Payment(s): 4 Monthly Payment(s) from 09/01/2024 to 12/31/2024 at $2,078.13 1 Monthly Payment(s) from 01/01/2025 to 01/30/2025 at $2,238.10 4 Monthly Payment(s) from 02/01/2025 to 05/15/2025 at $2,254.33 Total Late Charge(s): Total Late Charge(s) at $213.60 By this reason of said default the Beneficiary has declared all obligations secured by said Trust Deed immediately due and payable, said sums being the following, to-wit: The sum of $285,696.55 together with interest thereon at the rate of 6.25000% per annum from August 1, 2024 until paid; plus all accrued late charges thereon; and all Trustee's fees, foreclosure costs and any sums advanced by the Beneficiary pursuant to the terms of said Trust Deed. Wherefore, notice is hereby given that, the undersigned Trustee will on September 17, 2025 at the hour of 10:00 AM, Standard of Time, as established by Section 187.110, Oregon Revised Statues, At the front entrance to the Umatilla Courthouse, 216 S.E. 4th Street, Pendleton, OR 97801 County of Umatilla, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor had or had power to convey at the time of the execution by him of the said Trust Deed, together with any interest which the Grantor or his successors in interest acquired after the execution of said Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the Trustee. Notice is further given that any person named in Section 86.778 of Oregon Revised Statutes has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of said principal as would not then be due had no default occurred), together with the costs, Trustee's or attorney's fees and curing any other default complained of in the Notice of Default by tendering the performance required under the obligation or Trust Deed, at any time prior to five days before the date last set for sale.
